
Rep. Claudia Tenney (R-NY) said this week that the Biden administration should activate the 25th Amendment and transfer presidential authority to Vice President Kamala Harris following special counsel Robert Hur’s report that Biden would not be charged in the sensitive document investigation in part due to his faulty memory.
Tenney said that the Biden administration’s Cabinet should “explore” whether or not to use the amendment to transfer Biden’s powers to Vice President Kamala Harris.
Tenney said that Hur’s report “recited numerous instances in which President Biden exhibited dramatically compromised mental faculties and concluded that a jury would be likely to perceive President Biden as a sympathetic and forgetful old man.”
She then said that the president “needs to be charged, unless he is not mentally competent to stand trial.”
The representative then said that Hur’s report “makes a reasonable case that he is not.”
Tenney called upon the Cabinet to consider the choice to “remove the President pursuant to the 25th Amendment to the United States Constitution.”

The 25th Amendment allows for members of the presidential Cabinet to declare the president unable to discharge his duties and transfer authority to the vice president. This power has never been utilized.
Hur’s report indicated that Biden struggled with remembering key elements from his political career. As such, Hur concluded that if put on trial, “Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.”
Included in the report was evidence that Biden retained sensitive documents in his garage.
When asked about the collection of materials, Biden reportedly struggled to remember basic elements of the last decade. This allegedly included not remembering when he was vice president or when his son died.
Furthermore, after the report was released, the president held a press conference to deny that he was slipping mentally. During the event, the president confused Mexico for Egypt when discussing the ongoing conflict in the Middle East.
